Why is STAND going to Court?
We have run out of other choices: We reject the City's policy of granting unlimited variances We are concerned that 5-6 ++ story heights will set a precedent for Telegraph, Claremont, Shattuck, and Broadway: Why we chose a lawsuit:

1) We are not being heard about the 4801 Shattuck development (5 stories, 44 units) - nor any other development. We wrote letters, attended public meetings, and paid $710 to appeal but the City Council approved the project - as it has done with every other project.

2) We are challenging the Planning Department's practice of granting illegal, unlimited variances to projects and zoning on a project by project basis.

3) We want to challenge the approval of this huge number of condo projects--- over 2000 market rate condo units in Temescal alone - with no environmental review and study of cumulative impacts.

4) We want environmental and cumulative impact reviews. Under the California Environmental Quality Act, jurisdictions and local agencies are mandated to analyze the impacts of proposed projects BEFORE they're approved.

5) We want developers to involve the community early in the process.

6) We want a moratorium on the City approving upscale projects until it updates its zoning laws.
